GAY MARRIAGE LEGAL IN CALIFORNIA!!!

The California Supreme Court just ruled that the ban on Gay Marriage is unconstitutional in California! Check out the full story here.
This may mean that the marriages in San Francisco that were performed in 2004 (i.e. Kelli and Rosie) are once again legal!

Mayor Newsom reacts to the news with his staff. Newsom was instrumental in bringing teh issue to the CA Supreme Court and has been a constant advocate for equal rights. Risking his political career (which at one time was said to be on a path to the White House), Newsom fought relentlessly for the rights of the citizens in SF!update from one of our bloggers who is a lawyer in CA: "The remedy provided by today's majority opinion is PROSPECTIVE (albeit immediately). It does not provide a retroactive remedy for the plaintiffs. Accordingly, unless the Court issues an Order to the contrary, those persons married in 04 would need to re-wed (perhaps before Nov. if the amendment is approved for the ballot.)"

To amend my earlier comment, pursuant to CA law (as pertinent here), the remedy provided by the Court's opinion will take effect in 30 days. This time period is necessary and reasonable to allow the Clerks offices throughout the jurisdiction to amend their forms and update their staffs with respect to applicants for marriage licenses who are of the same sex (i.e., Mass. changed their marriage license application to read "Party A; Party B" instead of "Husband; Wife"). Interesting to note is that CA has no marriage residency requirement, so couples may apply for and receive a marriage license in CA without being residents (there is also no waiting period or blood test requirement). I have been recommending to my same sex clients in DPs to plan ahead if they wish to apply for licenses after the 30-day period is over. Some of the localities actually will take appointments for couples.

We need so many changes in the country --- it's tiring sometimes to think about.
